1. Scope and Definitions
1.1 These GTC govern all present and future contractual relationships between Models Express by A. Hang, or shortly Models Express, its models and its customers.
1.2 For the purposes of these GTC:
Model means any person applying to, commissioned by or cooperating with Models Express for creation, production, publication, promotion or monetization of content and related services.
Customer means any person or business purchasing, booking, subscribing to or otherwise receiving services or content from Models Express.
Business Partner means any affiliated company, operated brand, contractor, platform operator, agency or partner cooperating with Models Express.
1.3 Application forms, consent forms, booking confirmations, accepted selections and additional agreements form an integral part of these GTC.
1.4 Submission of online forms and electronic confirmations may replace handwritten signatures.
1.5 Where individual selections, categories or permissions are accepted in application forms, such accepted selections prevail over these GTC.
2. Services
2.1 Models Express may provide production, promotion, account management, customer mediation, monetization, accommodation, operational support and related services.
2.2 Models Express may perform such services directly or through affiliated companies, operated brands and business partners.
3. Nature of Content, Consent and Content Rights
3.1 Models Express operates services involving creation, publication, promotion and monetization of entertainment, creator and adult-oriented content intended for marketing, subscription, communication and commercial purposes.
3.2 Such content may include visual, audio, written, interactive and live formats and may be distributed through websites, social media platforms, creator platforms, subscription platforms and similar services.
3.3 The exact nature, categories, permitted activities, selected services and production scope are governed exclusively by the respective application form, consent form, accepted selections and later approved changes.
3.4 Users may grant Models Express rights to create, record, edit, reproduce, publish, distribute, display, promote and monetize content.
3.5 Publication may occur through websites, social media platforms, creator platforms, subscription platforms, partner channels and future services.
3.6 Publication may occur through accounts operated by Models Express or through accounts created in the user's name and on the user's behalf where authorized.
3.7 Rights granted under individual agreements may be delegated, sublicensed or assigned to affiliated companies, operated brands and business partners.
3.8 No model shall be required to participate in categories or productions not selected or approved through the application and consent process.
3.9 Users acknowledge that publication and monetization may result in visibility on public and third-party internet services and that complete control over third-party redistribution cannot be guaranteed.
4. Platform Accounts and Platform Terms
4.1 Where authorized, Models Express may create, operate and maintain profiles and accounts for promotion, audience development and monetization.
4.2 Such operation may include:
account setup and verification
content publishing
moderation and communication
platform administration
editing and deleting content
advertising and campaign management
revenue administration
4.3 Publication may occur on platforms including but not limited to Instagram, Facebook, TikTok, X, YouTube, Snapchat, Telegram, WhatsApp Channels, OnlyFans, Fansly, Fanvue, MYM Fans, 4Based and similar present or future services.
4.4 Users agree to comply with applicable platform requirements to the extent applicable to their participation, content or account operation.
4.5 Where accounts are created in the user's name and platform rules permit, Models Express may complete registration procedures and accept applicable platform terms, policies and creator agreements.
Where platform rules require direct acceptance, verification or participation, users agree to cooperate without undue delay.
5. Revenue Collection and Payments
5.1 Where authorized, Models Express may receive, collect, administer and process revenues generated through content and accounts.
5.2 Payment authority, commissions, deductions and payouts are governed by accepted agreements and applicable payment terms.
5.3 Revenue participation may be limited to monetized final published content.
5.4 Customers may be required to prepay.
5.5 Statements and settlements may be provided electronically.
6. Termination, Content Removal and Deletion
6.1 Termination applies only for the future.
6.2 Existing publications, sublicenses, accounts and active campaigns remain unaffected unless otherwise agreed.
6.3 Termination does not require deletion, withdrawal, recall, modification or interruption of content already published, distributed, sublicensed, archived or included in active campaigns before termination.
6.4 If a model requests complete removal or deletion of content, such request exceeds ordinary termination and shall be treated as a special content removal request.
6.5 Before initiating complete removal or deletion, Models Express may require prior reimbursement of:
documented costs reasonably incurred for production, publication, distribution and attempted removal of content;
documented costs for termination, withdrawal or revocation of sublicenses and business arrangements;
unpaid fees, advances, granted credits and accommodation benefits;
payouts already made which were contractually linked to content requested to be removed;
reasonable administrative, legal and technical costs connected with the removal request.
6.6 Reimbursement under Section 6.5 may be required before deletion or removal activities begin.
6.7 Complete deletion or removal shall only apply to content and publications within the reasonable technical and contractual influence of Models Express and its business partners.
6.8 Models Express does not guarantee deletion from third-party systems, external archives, user downloads, screenshots, recordings, mirrors, search engine caches, unauthorized copies or republications outside its influence.
6.9 Models Express may retain internal archives and records to the extent required for legal compliance, accounting, fraud prevention, evidence preservation and administration of existing contractual rights.
6.10 Revenue participation ends once removed content is no longer active and no longer generates revenue.
7. Customer Terms
7.1 Customers receive only a limited, non-exclusive, non-transferable and non-sublicensable right to use delivered content exclusively for the purpose confirmed by Models Express.
7.2 Customers shall not redistribute, sublicense, publish, resell, copy, commercially exploit or otherwise use content outside the approved scope.
7.3 Customers shall not train artificial intelligence systems or datasets using content unless expressly approved.
7.4 Models Express may suspend access or terminate usage rights in case of misuse.
8. Privacy and Confidentiality
8.1 Confidential information shall not be disclosed.
8.2 Privacy policies form an integral part of these GTC.
9. Final Provisions
9.1 Invalid provisions do not affect remaining provisions.
9.2 The latest accepted version applies.
9.3 Additional model or customer agreements may supplement these GTC.
